How to Search and Obtain Marriage Records or Marriage License in Florida

Weddings are wonderful and happy occasions. It takes a lot of work, to get everything coordinated and ensure all runs smoothly. Applying for your Florida marriage license is a vital part of all this preparation. Needed prior to any new marriage ceremony (they are not required for those who wish to renew their vows), these licenses are obtained at your local County Clerk�s office and may require up to a 3-day waiting period.

So who can apply for this marriage license? Males and females who are over the age of 18 years of age may apply for one, or if a minor�s parents are deceased and there is no other guardian appointed for this person, then they are able to apply. Minors who, under oath, swear that they are parents or expecting a child may also apply, provided they obtain a judge�s permission (a licensed physician must verify and write a statement regarding this pregnancy), or minors who were married previously or who have parental or guardian consent may also apply for a wedding license. Same-sex marriages are not permitted, at this time, in the State of Florida.

When applying for your marriage license, both you and your partner must be present at the County Clerk�s office (a listing will be provided at the end of this article) and both must present valid photo identification (driver�s license, state identification, or military identification). Additionally, you will have to produce your social security card or your valid passport and be able to pay the $93.50 fee. If you have previously attended a premarital preparation class, offered by an approved provider, your cost for a marriage license is only $61.00.

Those who have been previously married must also provide the date that their divorce was finalized or their partner�s death. If said divorce occurred within the last 30 days, then a certified copy of the divorce decree or the partner�s death certificate will be required.

While you do not need to take a blood test in order to get married in the State of Florida, each person that is applying for the license is required, by law, to read the �Family Law Handbook,� before they can receive their marriage license (a link, so that you may look over this handbook, is provided at the end of this article for your convenience). Once this is done and the required forms are filled out, licenses are issued immediately, but bear in mind that, unless you have attended an approved premarital preparation class, there will be a 3-day waiting period before the license is effective, allowing the marriage to take place. Those who are from out-of-state are not subject to the 3-day holding period.

Florida marriage licenses are good for 60 days after the date they were issued and are only valid for marriages performed within the State of Florida.
